I hit a pedestrian and want to know what my rights are.. Will i be sued by the pedestrian?

You could be sued. Lawyers love situations where a car strikes a pedestrian. Given the cirstances you describe, however, it seems unlikely that you could be held liable. Be sure you report the situation to your Insurance company right away and get a copy of the accident report including all the names of the witnesses. Your insurance company may decide to settle rather than go to the expense of a defense. Hopefully the hospital will take a blood alcohol test.
